    Special Levy for Efforts to Improve Service to Mid-Ohio Valley Regional Airport and for Use

    as Matching Funds for other Gifts, Grants and Transfers.

 

To authorize levies for the fiscal years beginning July 1, 2009, and ending June 30, 2010, and beginning July 1, 2010, and ending June 30, 2011, and beginning July 1, 2011, and ending June 30, 2012, and beginning July 1, 2012, and ending June 30, 2013, and beginning July 1, 2013, and ending June 30, 2014, respectively, for the purpose of providing for efforts to increase air service at the Mid-Ohio Valley Regional Airport, and for use as matching funds for grants, gifts or other transfers to the Wood County Airport Authority where matching funds are a condition of, or an inducement to, receipt of grants, gifts or other transfers, all as provided by an Order of the County Commission of Wood County, West Virginia, adopted the 25th day of August, 2008. 

The additional levy per $100.00 valuation shall be on Class I property, $0.061; on Class II property, $0.061; and on Class III property, $0.122; and on Class IV property, $0.122.  Said rates may be reduced for any levy year so that the proceeds of the levy shall be $2,821,450.00 per year.

ELECTION TO DETERMINE WHETHER THE

CHARTER OF THE CITY OF PARKERSBURG

SHALL BE AMENDED

 

The purpose of the amendments are to provide a definition of "resident of the City" (Section 10.108) and to provide for a more complete method of filling a vacancy in the Office of the Mayor (Section 3.103 and Section 3.104) for filling a vacancy in City Council [Subsection (2) of Section 2.206] and for permitting City Council by a 2/3 vote to waive the residency requirements for the City Engineer, City Attorney and or the Assistant City Attorney as hereby proposed and amended:
 
Section 10.112 Residency Defined of Article X, General Provisions
As used throughout this Charter, the term "resident of the City" shall mean that the individual has his primary residence located within the City Limits of Parkersburg, that he occupies that residence for a majority of each calendar year, that the West Virginia Department of Motor Vehicles and West Virginia Department of Tax and Revenue recognize that location as his legal residence, and that he is a qualified voter of The City of Parkersburg.

Section 3.103 Acting Mayor
Pending the selection of a Mayor to fill a vacancy or in case of the Mayor’s temporary absence or disability, the Mayor shall, by order delivered to the City Clerk, appoint an acting Mayor; or in the event the Mayor fails to designate such a person, the head of the Department of Finance shall temporarily act as Mayor; or if such department head be unable to act, Council shall appoint an acting Mayor. In any event, the person so appointed or designated shall, at the time of his appointment or designation, be an officer of the City, and shall not receive additional compensation for serving as acting Mayor. The Council shall have the power to declare by a 2/3 vote that the Mayor is temporarily disabled and to appoint an acting Mayor to act under the provisions of this section.

Section 3.104 Vacancy In Office
A vacancy occurring in the Office of the Mayor shall be filled as follows: Within ten (10) days after the occurrence of the vacancy, the Municipal Executive Committee of the party represented by the vacating Mayor shall submit a list of three (3) citizens with requisite qualifications to the City Clerk for presentation to and vote upon by the Council of the City at the next regular or special meeting of the Council. The City Council shall select one of the candidates to fill the vacancy for the unexpired term or until the next general election, whichever occurs first and which selection shall be voted by at least two-thirds (2/3) of the members attending.

Section 2.206 (2) Vacancies In Council
A vacancy occurring in the Office of any Councilman shall be filled as follows: Within ten (10) days after the occurrence of the vacancy, the Municipal Executive Committee of the party represented by the vacating Councilman shall submit a list of three (3) citizens with requisite qualifications to the Mayor. Within five (5) days of the submission of the list of candidates, the Mayor shall appoint one of the candidates to fill the vacancy for the unexpired term or until the next general election, whichever occurs first.

Chapter 2. Department of Public Works
Section 4.205 Qualifications of City Engineer.
The City Engineer shall be a professional engineer registered by the State of West Virginia. Each City Engineer hereafter appointed shall be a resident of the City and shall remain a resident of the City during the term of such appointment. Council shall be the judge of the residency qualification of the City Engineer who shall promptly report each change of residence to the Council. Council may waive the residency requirement for the City Engineer by a 2/3 vote.

Chapter 5. City Attorney
Section 4.500 Qualifications, Selection and Tenure
There shall be a City Attorney who shall possess the same qualifications as those required of the Municipal Judge. Council may waive the residency requirement for the City Attorney and Assistant City Attorney by a 2/3 vote. The City Attorney shall be appointed by the Mayor with the approval of Council to serve for a term not to extend beyond the term of the Mayor appointing him
